Welcome to Elegant Event Lighting. These Terms & Conditions (“Terms”) govern your use of our website located at https://eelchicago.com/ (the “Site”) and any booking, rental, design, or production services provided by us (the “Services”). By accessing our Site, submitting inquiries, or moving forward with an event proposal, you agree to be bound by these Terms. If you do not agree, please discontinue use of our Site and Services immediately.
1. Event Booking, Proposals & Retainers
All project proposals and initial custom estimates generated through our Site or GoHighLevel portal are valid for thirty (30) days from the date of issuance, after which pricing and equipment availability are subject to change. A booking is only officially secured upon:
- The execution of a formal, written Event Service Agreement signed by both an authorized representative of Elegant Event Lighting and the Client.
- The clear clearance of a non-refundable retainer payment (typically 20-50% of the gross contract value, as defined within your specific event proposal).
2. Payment & Billing Framework
Clients agree to adhere strictly to the schedule outlined within their individual service agreement. Final clear balances must be processed no later than thirty (30) days prior to the scheduled installation or event date. Elegant Event Lighting reserves the right to withhold installation, remove scheduled personnel, or cancel production entirely if balances remain outstanding past the payment deadline. We accept major credit cards, automated clearing house (ACH) bank drafts, and certified checks.
3. Production Adjustments, Postponements & Cancellations
Because custom decor, lighting arrays, and drapery installations involve extensive venue layout design, equipment reservations, and dedicated team scheduling, adjustments are governed by the following strict guidelines:
- Reductions in Scope: The Client may request minor revisions to their package order up to forty-five (45) days before the event, provided the total net contract value does not decrease by more than twenty percent (20%) of the initial booked amount.
- Postponements: If an event is rescheduled, all paid retainers may be transferred to the new date, subject to calendar availability and a potential date-change processing fee, provided written notice is received at least sixty (60) days prior to the original date.
- Cancellations: In the event of a total cancellation by the Client, all historical retainers are forfeited to cover administrative layout creation and turning away other prospective clients. Cancellations made within thirty (30) days of the event will require immediate settlement of 100% of the total remaining balance.
4. Site Conditions, Venue Access & Permissions
The Client is solely responsible for acquiring all required building clearances, architectural permissions, and power authorizations from the venue management. The venue must provide secure, continuous access for installation crews during the specified setup and teardown windows. If an installation is delayed or restricted due to venue constraints, lack of power, or uncooperative scheduling, Elegant Event Lighting cannot be held liable for incomplete setups, and additional hourly crew wait-fees may apply.
5. Equipment Integrity & Property Damages
All structural rigging, custom fabric backdrops, uplighting units, chandeliers, dance floors, and technical arrays provided remain the exclusive property of Elegant Event Lighting. The Client assumes full operational liability for any loss, theft, structural damage, or vandalism to the equipment occurring between the completion of setup and the initiation of teardown. The cost of repair or absolute replacement for damaged units will be invoiced directly to the Client.
6. Interactive Communication Consent (A2P SMS)
By providing your wireless telephone number to Elegant Event Lighting through our digital intake sheets, request forms, or lead captures, you provide your explicit consent to receive operational alerts, text notifications, scheduling synchronization updates, and promotional reminders from our administrative office via automated SMS networks. Standard carrier network data and messaging rates apply. You maintain the absolute right to cancel mobile communications at any time by replying STOP directly to any text message received. For system assistance, text HELP or call our customer line directly.
7. Intellectual Property
All design concepts, digital renderings, lighting plots, unique drapery layout schemes, and website content (including images, text, and logos) displayed on our Site or presented in custom proposals remain the intellectual property of Elegant Event Lighting. These materials are protected by copyright laws and may not be reproduced, copied, or utilized for third-party production without our express, written authorization.
8. Limitation of Liability
Elegant Event Lighting will exert every professional effort to execute installations seamlessly. However, our cumulative financial liability for any operational delays, hardware malfunctions, structural issues, or performance deficiencies under any legal theory is strictly limited to a maximum cap equal to the total net cash considerations paid to us by the Client under the specific event contract.
9. Governing Law
These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any legal actions or proceedings arising out of or relating to these Terms or our Services must be brought exclusively in the courts located in Cook County or DuPage County, Illinois.
10. Age Restriction
By using our Services, you represent and warrant that you are at least 18 years of age and possess the legal authority to enter into these Terms. If you are under the age of 18, you are strictly prohibited from using our Services or submitting any personal information to us.
11. Carrier Liability Disclaimer
Elegant Event Lighting shall not be held liable or responsible for any delays, damages, losses, or failures in performance resulting from the actions, omissions, negligence, or service disruptions of third-party carriers, shipping companies, or transportation providers utilized in connection with our Services.
